Privacy Notice

MarketYou is operated by THE FOUNDER UPGRADE L.L.C-FZ. This notice explains what data marketyou.consulting collects and how the current site handles it.

1. Controller and contact

The controller is THE FOUNDER UPGRADE L.L.C-FZ, license 2539350.01, registered at Meydan Grandstand, 6th floor, Meydan Road, Nad Al Sheba, Dubai, U.A.E. Privacy questions, complaints, and rights requests can be sent to salwa [at] marketyou.consulting.

2. What the forms collect

Book requests require a name, work email, and agreement to the processing needed for delivery. Information requests also require a first name, last name, service interest, and a short description of the visibility issue. Role, organization, and LinkedIn URL are optional. The assessment form sends the name and email you enter together with the calculated score, band, and communication archetype. It does not send your individual answers. The record also includes the submission time, source page, notice version, and confirmation that the required request-processing box was selected.

If a required field is missing, we cannot answer the request or issue the private book link. Please do not put confidential employer or client information, health data, identity documents, financial details, or other sensitive data in the message field.

3. Why the data is used

We use form data to deliver the book, read and answer the request, and take steps you ask us to consider before a possible engagement. We also process limited technical information, including an IP address during a request, to rate-limit abuse and secure the service. The application does not add form submissions to a marketing list.

4. Assessment logic

The first fourteen answers produce a score from 14 to 56. Scores from 14 to 21, 22 to 31, 32 to 42, and 43 to 56 map to the four bands shown on the result screen. Five further answers indicate the most frequent Trust, Mystic, or Power choice; a tie is resolved by the first tied choice. The result is an educational prompt. It does not change service eligibility, price, or access, and no decision with legal or similarly significant effect is made automatically.

5. Legal grounds

Where EU or UK data-protection law applies, the grounds are your request and steps before a possible contract, legitimate interests in operating and securing the site, and legal obligations where relevant. The required checkbox records the specific request-processing permission shown beside the form. UAE processing is handled under the laws applicable to the controller. Nothing in this notice limits rights that apply under a mandatory federal or free-zone rule.

6. Storage, recipients, and access

The website and encrypted server connection are hosted on infrastructure supplied by Hetzner. Form records are stored in a private file on the MarketYou application server. At launch, the forms do not send data to a CRM, email-marketing platform, advertising service, or analytics provider. Access is limited to people working for the controller who need the record to answer or administer the request. We do not sell personal data.

7. International access and transfers

The controller is established in Dubai and its staff may access requests from the countries in which they work. The hosting provider may process data in the European Economic Area. When a transfer safeguard is legally required, the controller will use the appropriate mechanism and can provide information about it on request. Before adding a new vendor or destination, MarketYou records the purpose, location, access, contract, and transfer basis.

8. Retention

Form records are deleted 365 days after submission unless they have become part of an active client relationship or must be kept longer for a legal obligation or claim. A daily automated job enforces the 365-day limit; the service also checks retention when it accepts a new record. Invalid or undated records are removed. The short-lived book token expires after 24 hours and contains no name or email address.

9. Rights and complaints

Depending on the law that applies, you may ask for access, correction, deletion, restriction, objection, or a portable copy. You may also withdraw a consent without affecting earlier processing. We aim to acknowledge a request within five business days and respond within the period required by applicable law, normally one month where EU or UK law applies. We may ask for proportionate identity evidence and will explain any extension or refusal. You may also complain to the competent UAE authority, the UK Information Commissioner if UK law applies, or the supervisory authority in your EEA country if EEA law applies.

10. Cookies and browser storage

The launch version has no advertising cookies, behavioral tracking, or non-essential analytics. The assessment runs in the browser and does not place answers in cookies or local storage. Necessary network and security mechanisms may still process request data. We will revise this notice and add any required choice before introducing non-essential tracking.

11. Security, children, and changes

We use access controls, restricted file permissions, transport encryption, request validation, rate limits, and a private, expiring download route. No system can be guaranteed completely secure. The site is intended for professionals and not for anyone under 18. Material changes to this notice will appear here with a revised date.
